Dear Sir/Madam,


I am a citizen of the Republic of Korea, which currently has a free trade agreement with the United States. I am writing to bring to your attention a recent move by the Korean government to amend our customs laws in a manner that I believe violates the principles of the Korea-US Free Trade Agreement (KORUS FTA).


The proposed amendments seek to restrict the direct purchase of foreign goods by Korean citizens under the pretext of protecting domestic demand. Specifically, the government plans to ban the importation of products that do not have KC (Korea Certification) safety certification. This proposed law includes 80 categories of products closely related to daily life, such as toys, batteries, and sterilizers. This would effectively prevent most international products that lack KC certification from being imported into Korea.


However, it is important to note that the KC certification system has previously failed to ensure product safety, as evidenced by the humidifier sterilizer scandal and the widely publicized Galaxy Note 7 explosions. This proposed law could disproportionately impact goods from the United States and other allied countries.


Moreover, this amendment appears to be a clear violation of the Korea-US Free Trade Agreement. According to Article 4, Section 2.8 of KORUS FTA, except as otherwise provided in the agreement, neither party may adopt or maintain any prohibition or restriction on the importation or sale for exportation of goods of the other party, except in accordance with Article XI of the GATT 1994 and its interpretative notes.


In light of these concerns, I urge you to protest these proposed violations and take appropriate action to ensure that the principles of the Korea-US Free Trade Agreement are upheld.
